Acceptance
By using this website you agree to these terms. Purchasing data requires, in addition, your affirmative acceptance of the Data License at checkout. If you do not agree, do not use the site or purchase data.
“We”, “us” and “the company” mean [LEGAL ENTITY NAME — PENDING]. “You” means the person or business using the site.
Accounts
- You must be at least 18 and acting on behalf of a business.
- Registration information must be accurate and kept current.
- You are responsible for your credentials and for everything done under your account.
- One account per person or business.
- We may suspend or terminate an account that breaches these terms or the Data License.
Credits
- Credits have no cash value and are not redeemable for money.
- Credits purchased as packs expire 12 months after purchase.
- Subscription credits roll over while the subscription is active and expire 60 days after cancellation.
- Credits are not transferable between accounts.
- The credit cost of a record varies by record type. The applicable cost is shown before you purchase.
Subscriptions
- Subscriptions are billed monthly, in advance.
- Cancellation takes effect at the end of the current billing period. There are no partial-period refunds.
- If a payment fails, monthly credit grants pause. Your existing balance is not deleted.
- Prices may change with notice to existing subscribers.
Refunds
Refunds are issued as account credits, not cash, when requested within 7 days of purchase and before the file has been downloaded more than once.
Because data is licensed non-exclusively and provided as-is, a list that did not produce the results you hoped for is not a basis for a refund. See the Data License.
Prohibited use
You may not:
- Scrape, crawl, or automatically extract anything from the site.
- Attempt to obtain data other than through a completed purchase.
- Circumvent credit limits, rate limits, preview masking, or any other control.
- Resell, share, or transfer access to an account.
- Reverse engineer any part of the site or its software.
Intellectual property
The site, its software, and the compilation, classification, and scoring of the data are the company’s property. Purchasing records grants the license described in the Data License and nothing else.
Disclaimers and limitation of liability
The site and all data are provided “as is” and “as available” without warranty of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
To the fullest extent permitted by law, the company’s total liability arising from the site or any purchase is capped at the fees you paid in the three months before the claim. The company is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, in any case.
Indemnification
You will indemnify, defend, and hold harmless the company and its officers from any claim, penalty, fine, damage, cost, or expense, including reasonable attorneys’ fees, arising from your use of the site or of any data, or from your breach of these terms or the Data License.
Termination
We may suspend or terminate your access for breach. Sections on credits, intellectual property, disclaimers, limitation of liability, indemnification, and governing law survive termination.
Governing law and disputes
These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Pennsylvania, and you consent to their jurisdiction.
Changes to these terms
We may update these terms. The version number at the top changes when we do, and material changes are notified to account holders by email. Continued use after a change is acceptance of the new terms. Previous versions are available on request at support@getbrightleads.com.
